By placing an order for a custom portrait, you agree to the following terms and conditions:
Payment Terms
All commissions are custom-made based on client-provided reference photos.
A 50% non-refundable deposit is required to secure your booking. Work begins only after the deposit has been received.
The remaining balance is due once the artwork is completed and approved by you. Once the final payment is made, the portrait will be shipped.
No Refund Policy: As the deposit is non-refundable, there are no cancellations or refunds once the order has been placed and the deposit is paid.
Prices are subject to change.
Reference Photos
The quality of the final artwork depends heavily on the quality of the reference images provided.
Clients are responsible for supplying clear, well-lit photos. While I do my best with all material provided, I cannot guarantee hyper-realistic results from low-quality or heavily cropped images.
Turnaround Time
Completion times vary depending on size, complexity, and current workload. Estimated timelines will be discussed individually.
If your commission is needed by a specific date, please contact me before booking to confirm availability.
Cancellations & Adjustments
Due to the custom nature of commissioned artwork, deposits and completed artworks are non-refundable.
Once the deposit is paid and the commission is confirmed, you may cancel the order but the deposit will not be refunded. If a commission is cancelled after work has begun, the deposit will be retained.
I reserve the right to cancel a commission at any time, for any reason, including but not limited to personal circumstances, inability to complete the work to the required standard, or issues with reference materials (e.g., low-quality photographs). If I cancel the commission, you will receive a full refund of any payments made, including the deposit.
Adjustments: Adjustments may be requested, but I cannot guarantee that changes can be made after work has commenced. The possibility and scope of adjustments will depend on the stage of the artwork.
Artist’s Right to Cancel
I reserve the right to cancel a commission at any time, for any reason, including but not limited to personal circumstances, inability to complete the work to the required standard, or issues with reference materials (e.g., low-quality photographs). If I cancel the commission, you will receive a full refund of any payments made, including the deposit.
No further compensation or claims will be accepted beyond the full refund of payments.
Artist’s Sharing Rights
I reserve the right to share the completed artwork, including on Instagram, TikTok, Facebook, my website, or other promotional materials, unless you specifically request otherwise at the time of booking.
If you would prefer that your artwork not be shared publicly, or if you would like me to wait for a specific period before sharing (e.g., if the portrait is a gift), please inform me at the time of the order.
Packaging & Shipping
All artwork is carefully packaged and shipped tracked. I will not be responsible for any damages that occur during shipping.
Delivery costs will be calculated based on your location and will be added to the final payment.
Silvana Moldovan is not responsible for delays caused by postal services or customs.
International buyers are responsible for any customs fees or import taxes.
Contact and Communication
Please provide all necessary details when placing your order, including the size of the portrait, preferred style, and any special requests.
If you would like updates or progress photos, please inform me at the time of booking.
Legal Ownership – applicable for originals
Upon final payment, you will receive the physical artwork, and it will be yours to display or gift as you wish. However, I retain the copyright and reproduction rights to the artwork, unless otherwise agreed upon in writing.
You may not reproduce the artwork without prior written permission.
Privacy
I take your privacy seriously and am committed to protecting your personal information. Any personal details you provide, such as your name, contact information, and shipping address, will be used solely for the purpose of processing and delivering your commission.
I will never share, sell, or disclose your information to third parties, except as required for shipping or legal purposes.
If you choose to communicate via email or social media, your information will be kept secure and confidential.
If you request that your commissioned artwork not be shared publicly, I will fully respect your request.
